El doctor Linares adujo que de la norma cuestionada se podría derivar un interés en la decisión que llegare a adoptar la Corporación.

La Sala Plena no encontró cumplidas las condiciones para que la configuración del posible impedimento del doctor Linares, debido a que se trata de disposiciones que no tienen incidencia actual y directa en el ejercicio de su actividad judicial, por lo cual no afecta el cumplimiento de su deber de imparcialidad para decidir sobre su constitucionalidad.

Con base en lo anterior se declara INFUNDADO.
